VirtuaDash Terms of Service

These Terms of Service (“Terms”) form a legal agreement between you (“User,” “you,” or “your”) and Arjun Rajan, developer of VirtuaDash (“we,” “our,” or “us”). They govern your access to and use of the VirtuaDash desktop application (“Software”) and related services.
By downloading, installing, accessing, or using VirtuaDash, you agree to these Terms. If you do not agree, do not use the Software.
1. Relationship with the End User License Agreement (EULA)
- The use of the VirtuaDash Software is governed by our End User License Agreement (EULA).
- The EULA defines how the Software may be installed and used.
- In case of conflict between these Terms and the EULA regarding software usage, the EULA will prevail.
- These Terms govern your broader relationship with us, including subscriptions, acceptable use, and liability.
2. Eligibility
You must be legally capable of entering into a binding agreement to use VirtuaDash. If you are using VirtuaDash on behalf of an organization, you confirm that you have authority to bind that organization.
3. Trial & Subscriptions
- VirtuaDash may be offered as a time-limited free trial.
- After the trial period, continued use requires an active paid subscription.
- Subscription plans, pricing, billing cycles, and renewal terms are presented at the time of purchase.
- Payments, billing, taxes, and refunds are processed by our authorized payment provider, Paddle.com Market Ltd ("Paddle"), which acts as the Merchant of Record. By purchasing a subscription, you agree to Paddle’s applicable terms and policies.
- Refunds are governed by our Refund Policy available on our website.
- You may cancel a subscription at any time; access remains valid until the end of the current billing period.
4. License Key & Device Use
- Each subscription is associated with a license key and may be activated on one device at a time.
- You may transfer your license between devices you personally own or control. However, simultaneous active use on multiple devices is not permitted.
- We may implement reasonable technical measures to enforce license limits and prevent misuse.
- You are responsible for keeping your license key secure and confidential.
5. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the Software’s source code.
- Bypass or disable licensing, security, or usage restrictions.
- Use the Software for unlawful purposes or to violate the rights of others.
- Resell, rent, sublicense, or redistribute the Software without written permission.
6. Data & Privacy
VirtuaDash is a desktop application that may require an internet connection for certain features, including but not limited to license validation, subscription management, map services, and update checks. Core functionality may be limited without internet access. We handle data in accordance with our Privacy Policy.
7. Third-Party Services
Certain features of VirtuaDash rely on third-party services, including but not limited to payment processing, cloud hosting, and map data providers. We are not responsible for interruptions, outages, or issues caused by third-party services beyond our control.
8. Intellectual Property
All rights, title, and interest in the Software, including branding, design, and code, remain the property of Arjun Rajan. No rights are granted except as expressly stated.
8. Disclaimer of Warranty
VirtuaDash is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that the Software will be error-free, uninterrupted, or suitable for every purpose.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of or related to your use of the Software shall not exceed the amount you paid to us for the Software during the twelve (12) months preceding the event giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
10. Termination
We may suspend or terminate your license if you violate these Terms or the EULA. Upon termination, you must stop using the Software and delete all copies.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Thiruvananthapuram, Kerala, India.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the website or in-app notice.
