VirtuaDash End User License Agreement (EULA)

This End User License Agreement (âAgreementâ) is a legal agreement between you (âYouâ or âUserâ) and Arjun Rajan, developer of VirtuaDash⢠(âLicensorâ). It governs the licensing and use of the VirtuaDash software (âSoftwareâ).
By installing or using VirtuaDash, you agree to this Agreement. If you do not agree, do not install or use the Software.
1. Relationship with the Terms of Service
- This EULA governs how the Software is licensed and used.
- The Terms of Service govern subscriptions, payments, and your broader relationship with us.
- If there is a conflict regarding software usage, this EULA prevails.
2. License Grant
Subject to compliance with this Agreement and an active trial or subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use VirtuaDash on devices you own or control.
All rights not expressly granted are reserved.
3. License Scope & Device Use
- Each subscription permits activation on one device at a time.
- You may transfer your license between devices you personally own or control.
- Simultaneous active use on multiple devices is not permitted.
- The Software may use reasonable technical measures, including device identification mechanisms, to enforce license limits.
4. Trial & Subscription Use
- The Software may operate under a time-limited free trial.
- After the trial period, continued use requires an active paid subscription.
- Access to features may vary depending on your subscription status.
5. Restrictions
You may not:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
- Bypass, disable, or circumvent license validation, subscription enforcement, device identification mechanisms, or other technical protection measures.
- Modify or create derivative works based on the Software.
- Rent, lease, sublicense, sell, distribute, or make the Software available to third parties without written permission.
- Use the Software for illegal or unauthorized purposes.
6. Ownership
The Software is licensed, not sold. All intellectual property rights, including copyrights and trademarks, remain the exclusive property of Arjun Rajan.
7. Updates & Modifications
We may release updates, patches, or modifications to improve functionality, security, or compatibility.
Continued use of the Software may require installation of updates. We reserve the right to modify or discontinue features at any time.
8. Third-Party Services
Certain features of the Software may rely on third-party services, including but not limited to map services or license infrastructure. We are not responsible for interruptions or failures caused by third-party services beyond our control.
9. Feedback
If you provide feedback, ideas, or suggestions regarding the Software, you grant us a perpetual, royalty-free, irrevocable right to use and incorporate such feedback without obligation or compensation.
10. Termination
This Agreement remains in effect until terminated.
Your license automatically terminates if you breach this Agreement. Upon termination, you must cease all use of the Software and uninstall and delete all copies from your devices.
Continued use after termination is unauthorized.
11. Disclaimer and Limitation of Liability
The Software is provided âas isâ and âas available,â without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the maximum extent permitted by applicable law, Arjun Rajan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, or system failure, arising out of or related to the use of or inability to use the Software.
In no event shall total liability exceed the amount paid by you for the Software during the twelve (12) months preceding the claim, or zero if the Software was used under a free trial.
12. Governing Law
This Agreement is governed by the laws of India. Any disputes fall under the exclusive jurisdiction of the courts of Thiruvananthapuram, Kerala, India.
